Terms of Use

These terms are an agreement between you and Mohamed Bassiuony, trading as Global Parts (جلوبال بارتس), Alexandria, Egypt ("we"), who makes Mishmish (مشمش). You accept them by ticking the box in the app before you sign in. If you do not agree, please do not use the app. Contact: support@mishmishbook.app.

1. Who may use it

Anyone can use Mishmish; there is no age limit. If you are under 18, a parent or legal guardian must agree to these terms for you, and is responsible for your use of the app and for any purchase. One account is for one person.

2. What the app is, and is not

Mishmish is a health book you keep for your cat or dog: vaccines, medicines, visits, reminders, and a list of vets who joined. It is not a vet and gives no medical advice. It does not decide doses or treatments. Reminders can be late or missed (a phone setting, a flat battery); keep your own eye on important dates. In an emergency, go to a vet at once.

3. Your account and your phone

Keep your phone and your email safe. Tell us at once if you think someone else used your account; you can sign out every other phone in Settings, Sign-in and security. Throwaway email addresses are refused. We may check that the app and the phone are genuine (Google Play Integrity, Apple App Attest) and limit sensitive actions on a phone that fails.

Usage counts. To find bugs and make the app better, the app counts which screens are used and notes its own errors, anonymously and without your records (details in the Privacy Policy). This is on when you start; you can turn it off at any time in Settings, Help improve the app. Detailed crash reports are sent only if you say yes.

4. Your records

What you write stays yours. You let us store, copy and send it only as far as needed to give you the features you use (for example family share, or showing a vet your pet’s book). You are responsible for what you enter. A record signed by a vet is the vet’s statement; the vet answers for its content.

5. Vets and reviews

• We check each vet by hand before listing them. A listing is not a recommendation, and the vet, not us, is responsible for their professional work.
• Only someone who contacted or visited a clinic from the app can review it. Write about your own real experience, without insults, threats, private details, ads, phone numbers or links, and without saying things you know are false.
• We check reviews and may hide or remove one that breaks these rules or the law. Anyone can report a review; a clinic can answer each review once. We act quickly when a review is reported as unlawful.
• Zero tolerance. There is no place in the app for objectionable content (nudity, violence or gore, hate, harassment, threats, scams) or for abusive users. You can report anything you see and block any person, so their reviews and street spots no longer show to you (undo it in Settings, Sign-in and security). We look at every report within 24 hours, remove what breaks these rules, and close the account of whoever posted it.

6. Street friends

Caring for street animals is your own choice and at your own risk. Follow the safety tips in the app. If you are bitten or scratched, wash the wound and go to a hospital the same day.

7. Subscriptions: Plus, Family and Clinic

All subscriptions are optional, monthly, and sold by Apple or Google. The health book, reminders, widgets, the vet list and sharing pets with one other person stay free.

• Mishmish Plus, for one owner: more AI scans each month and the extras shown in the app.
• Mishmish Family, for 2 to 6 people that you choose: Plus for everyone in the family and shared pets, ticks and reminders. One person pays, and the price rises with each person added.
• Mishmish Clinic, only for vets we have checked: the clinic shows near the top of Nearby with a badge, plus patients, a month log, reminders and unlimited signed records.

The price is shown in the store, in your currency and including taxes, before you pay. In Egypt the App Store prices are EGP 39.99 for Plus, EGP 59.99 to 119.99 for Family (2 to 6 people) and EGP 299.99 for Clinic each month; Google Play prices can differ by a few piastres. A subscription renews every month until you cancel it in your Apple or Google account, and stays on until the end of the month you paid for. Refunds follow Apple’s or Google’s rules. We never charge you twice for the same plan: if you change plan, the store moves you over. If we change a price, the store tells you before your next renewal. If we offer a free period (for example to founding clinics), the app shows it before you subscribe.

8. Fair use

Do not: break the law with the app; harm, impersonate or harass anyone; post fake reviews or reviews for pay; scrape the vet list; try to reach data that is not yours, get around limits, tamper with the device check, or attack or overload our servers; copy or resell the app. We may suspend or close an account that does, and keep what the law requires.

8b. Intellectual property, copyright and takedowns

What is ours. The name Mishmish (مشمش), the Mishmish cat, the icons, the pixel art, the animations, the text and the code of the app and this website belong to us and are protected by Egypt’s Intellectual Property Law (Law 82 of 2002) and international copyright treaties. You may use the app for yourself, but do not copy, sell, or reuse them without our written permission. The fonts are used under the SIL Open Font License. Apple, App Store, Google, Google Play and WhatsApp are trademarks of their owners.

What you post. Post only what you wrote or have the right to share. You keep the rights in your reviews and street spots. You let us show them in the app for as long as they are up.

Copyright notices (Egyptian law and the US DMCA). If you think something in the app or on this website uses your work without permission, email our copyright agent at support@mishmishbook.app. Our agent is Mohamed Bassiuony, Global Parts, Alexandria, Egypt. Include: (1) your name, address, phone and email; (2) the work you own; (3) where the content is in the app (the clinic, review or street spot) or the page address; (4) a statement that you believe in good faith the use is not allowed by the owner, its agent or the law; (5) a statement that your notice is accurate and, under penalty of perjury, that you own the work or are allowed to act for its owner; (6) your physical or electronic signature (typing your full name is enough). We remove or disable the content quickly, tell the person who posted it, and close the accounts of people who repeatedly post others’ work.

Counter-notice. If your content was removed by mistake, email us with: your name, address, phone and email; what was removed and where it was; a statement, under penalty of perjury, that you believe in good faith it was removed by mistake; your agreement to the courts of Alexandria, Egypt (or, if you live in the United States, your local federal court), and that you accept service from the person who sent the notice; and your signature. Unless the person who sent the notice tells us they have started court action, we may restore the content after 10 to 14 working days.

9. The service

We work to keep the app available and correct, but it is provided as it is, and it can change, pause or stop. Keep a backup (Settings, Your data).

10. Limit of liability

(a) We are not liable for indirect or unforeseeable losses, or for what a vet, a store, or another user does.

(b) For any other claim under these terms, our total liability to you is limited to the greater of what you paid us in the 12 months before the claim, or EGP 500.

(c) Nothing in these terms limits or excludes liability for fraud or gross negligence, for harm caused by an unlawful act, or any right the Consumer Protection Law (Law 181 of 2018) or another mandatory law gives you that cannot be waived.

11. Ending

You can stop at any time and delete your account in Settings. We may end these terms for you if you seriously or repeatedly break them, after telling you why when we can.

12. Law and disputes

Egyptian law applies. Please write to us first; we answer within 14 days. If we cannot agree, the courts of Alexandria have jurisdiction, and you keep your right to complain to the Consumer Protection Agency (hotline 19588) or the Personal Data Protection Center.

13. Changes

If we change these terms, we update this page, its date and version, and ask you to agree again in the app before the change applies to you.

شروط الاستخدام

هذه الشروط اتفاق بينك وبين محمد بسيوني، من خلال جلوبال بارتس (Global Parts)، الإسكندرية، مصر («نحن»)، مطوّر مشمش (Mishmish). تقبلها بوضع علامة في المربع داخل التطبيق قبل تسجيل الدخول. إذا لم توافق، نرجو ألا تستخدم التطبيق. للتواصل: support@mishmishbook.app.

١. من يجوز له الاستخدام

يمكن لأي شخص استخدام مشمش؛ لا يوجد حد للسن. وإذا كان عمرك أقل من 18 سنة، يجب أن يوافق الوالد أو الولي القانوني على هذه الشروط نيابةً عنك، ويكون مسؤولًا عن استخدامك للتطبيق وعن أي عملية شراء. الحساب الواحد لشخص واحد.

٢. ما هو التطبيق، وما ليس هو

مشمش دفتر صحي تحتفظ به لقطتك أو كلبك: التطعيمات والأدوية والزيارات والتذكيرات، وقائمة بالأطباء المنضمّين. التطبيق ليس طبيبًا بيطريًا ولا يقدم نصيحة طبية، ولا يحدد الجرعات أو العلاج. قد تتأخر التذكيرات أو لا تصل (إعداد في الهاتف أو بطارية فارغة)؛ فتابع المواعيد المهمة بنفسك أيضًا. وفي الطوارئ اذهب إلى الطبيب البيطري فورًا.

٣. حسابك وهاتفك

حافظ على هاتفك وبريدك. أخبرنا فورًا إذا ظننت أن غيرك استخدم حسابك؛ ويمكنك تسجيل الخروج من كل الهواتف الأخرى من الإعدادات، الدخول والأمان. لا نقبل عناوين البريد المؤقتة. وقد نتحقق من أن التطبيق والهاتف حقيقيان (Google Play Integrity وApple App Attest) ونقيّد العمليات الحساسة على هاتف لا يجتاز الفحص.

عدّ الاستخدام. لاكتشاف الأخطاء وتحسين التطبيق، يعدّ التطبيق الشاشات المستخدمة ويسجّل أخطاءه، بشكل مجهول وبدون سجلاتك (التفاصيل في سياسة الخصوصية). وهذا مفعّل من البداية، ويمكنك إيقافه في أي وقت من الإعدادات، «ساعدنا نحسّن التطبيق». أما تقارير الأعطال المفصّلة فلا تُرسل إلا بموافقتك.

٤. سجلاتك

ما تكتبه يبقى ملكك. وتسمح لنا بتخزينه ونسخه وإرساله فقط بالقدر اللازم لتقديم الميزات التي تستخدمها (مثل مشاركة العائلة أو عرض دفتر حيوانك على الطبيب). وأنت مسؤول عما تُدخله. والسجل الذي يوقّعه طبيب هو إقرار من الطبيب، والطبيب مسؤول عن محتواه.

٥. الأطباء والتقييمات

• نراجع كل طبيب يدويًا قبل إدراجه. والإدراج ليس توصية، والطبيب لا نحن مسؤول عن عمله المهني.
• لا يقيّم العيادة إلا من تواصل معها أو زارها من التطبيق. اكتب عن تجربتك الحقيقية فقط، بدون سب أو تهديد أو بيانات خاصة أو إعلانات أو أرقام هواتف أو روابط، ودون ادعاء ما تعلم أنه غير صحيح.
• نراجع التقييمات ويجوز لنا إخفاء أو حذف ما يخالف هذه القواعد أو القانون. ويمكن لأي شخص الإبلاغ عن تقييم، ويمكن للعيادة الرد مرة واحدة على كل تقييم. ونتصرف سريعًا عند الإبلاغ عن تقييم مخالف للقانون.
• لا تسامح مطلقًا. لا مكان في التطبيق لأي محتوى مسيء (عُري أو عنف أو مشاهد دموية أو كراهية أو مضايقة أو تهديد أو احتيال) ولا للمستخدمين المسيئين. يمكنك الإبلاغ عن أي شيء تراه وحظر أي شخص، فلا تظهر لك تقييماته ولا أماكن حيوانات الشارع الخاصة به (ويمكنك التراجع من الإعدادات، تسجيل الدخول والأمان). نراجع كل بلاغ خلال 24 ساعة، ونحذف ما يخالف هذه القواعد، ونغلق حساب من نشره.

٦. حيوانات الشارع

رعاية حيوانات الشارع اختيارك وعلى مسؤوليتك. اتبع نصائح الأمان في التطبيق. وإذا تعرّضت لعضّة أو خدش، اغسل الجرح واذهب إلى المستشفى في نفس اليوم.

٧. الاشتراكات: Plus والعائلة والعيادة

كل الاشتراكات اختيارية وشهرية، وتبيعها Apple أو Google. ويظل الدفتر الصحي والتذكيرات والودجتس وقائمة الأطباء ومشاركة الحيوانات مع شخص واحد آخر مجانية.

• مشمش بلس لصاحب واحد: مسحات أكثر بالذكاء الاصطناعي كل شهر والإضافات المعروضة في التطبيق.
• عيلة مشمش من 2 إلى 6 أشخاص تختارهم: بلس لكل أفراد العائلة، وحيوانات وعلامات وتذكيرات مشتركة. يدفع شخص واحد، ويزيد السعر مع كل شخص يُضاف.
• مشمش للعيادات للأطباء الذين راجعناهم فقط: تظهر العيادة في أول «القريب منك» بعلامة مميزة، مع المرضى وسجل الشهر والتذكيرات والسجلات الموقّعة بدون حد.

يُعرض السعر في المتجر بعملتك وشاملًا الضرائب قبل الدفع. وفي مصر أسعار App Store الشهرية: 39.99 جنيه لبلس، ومن 59.99 إلى 119.99 جنيه للعائلة (من 2 إلى 6 أشخاص)، و299.99 جنيه للعيادة؛ وقد تختلف أسعار Google Play ببضعة قروش. يتجدد الاشتراك كل شهر حتى تلغيه من حساب Apple أو Google، ويظل مفعّلًا حتى نهاية الشهر المدفوع. ويخضع الاسترداد لقواعد Apple أو Google. لا ندفّعك مرتين أبدًا لنفس الخطة: وإذا غيّرت خطتك ينقلك المتجر إليها. وإذا غيّرنا السعر يُخطرك المتجر قبل التجديد التالي. وإذا قدّمنا فترة مجانية (مثل العيادات المؤسِّسة) يعرضها التطبيق قبل أن تشترك.

٨. الاستخدام العادل

لا يجوز: مخالفة القانون باستخدام التطبيق؛ أو إيذاء أحد أو انتحال شخصيته أو مضايقته؛ أو نشر تقييمات مزيفة أو مدفوعة؛ أو نسخ قائمة الأطباء آليًا؛ أو محاولة الوصول لبيانات ليست لك أو تجاوز الحدود أو التلاعب بفحص الجهاز أو مهاجمة خوادمنا أو إغراقها؛ أو نسخ التطبيق أو إعادة بيعه. ويجوز لنا إيقاف أو إغلاق أي حساب يفعل ذلك، مع الاحتفاظ بما يشترطه القانون.

٨ب. حقوق الملكية الفكرية وطلبات الإزالة

ما نملكه. اسم مشمش (Mishmish) وقطة مشمش والأيقونات ورسوم البكسل والحركات ونصوص التطبيق وهذا الموقع وكودهما ملك لنا، ومحمية بقانون حماية حقوق الملكية الفكرية المصري رقم 82 لسنة 2002 والاتفاقيات الدولية لحقوق المؤلف. يمكنك استخدام التطبيق لنفسك، لكن لا يجوز نسخها أو بيعها أو إعادة استخدامها بدون إذن كتابي منا. والخطوط مستخدمة وفق رخصة SIL Open Font License. وApple وApp Store وGoogle وGoogle Play وWhatsApp علامات تجارية لأصحابها.

ما تنشره. انشر فقط ما كتبته بنفسك أو ما يحق لك مشاركته. تبقى حقوق تقييماتك وأماكن حيوانات الشارع لك، وتسمح لنا بعرضها في التطبيق طالما هي منشورة.

بلاغات حقوق المؤلف (القانون المصري وقانون DMCA الأمريكي). إذا رأيت أن شيئًا في التطبيق أو على هذا الموقع يستخدم عملك بدون إذن، راسل وكيلنا لحقوق المؤلف على support@mishmishbook.app. ووكيلنا هو محمد بسيوني، جلوبال بارتس، الإسكندرية، مصر. اذكر: (1) اسمك وعنوانك وهاتفك وبريدك؛ (2) العمل المملوك لك؛ (3) مكان المحتوى في التطبيق (العيادة أو التقييم أو مكان حيوانات الشارع) أو عنوان الصفحة؛ (4) إقرارًا بأنك تعتقد بحسن نية أن المالك أو وكيله أو القانون لا يسمح بهذا الاستخدام؛ (5) إقرارًا بأن بلاغك صحيح، وأنك تحت طائلة المسؤولية القانونية مالك العمل أو مفوَّض عنه؛ (6) توقيعك الفعلي أو الإلكتروني (كتابة اسمك الكامل تكفي). نزيل المحتوى أو نوقفه سريعًا، ونبلغ من نشره، ونغلق حسابات من يكرر نشر أعمال الآخرين.

الاعتراض على الإزالة. إذا أُزيل محتواك خطأً، راسلنا مع: اسمك وعنوانك وهاتفك وبريدك؛ وما أُزيل ومكانه؛ وإقرارًا تحت طائلة المسؤولية القانونية بأنك تعتقد بحسن نية أنه أُزيل خطأً؛ وموافقتك على اختصاص محاكم الإسكندرية بمصر (أو محكمتك الفيدرالية إن كنت تعيش في الولايات المتحدة) وقبولك الإخطار من صاحب البلاغ؛ وتوقيعك. وما لم يخبرنا صاحب البلاغ أنه رفع دعوى، يجوز لنا إعادة المحتوى بعد 10 إلى 14 يوم عمل.

٩. الخدمة

نعمل على أن يبقى التطبيق متاحًا وصحيحًا، لكنه يُقدَّم بحالته، وقد يتغير أو يتوقف مؤقتًا أو نهائيًا. احتفظ بنسخة احتياطية (الإعدادات، بياناتك).

١٠. حدود المسؤولية

(أ) لا نُسأل عن الخسائر غير المباشرة أو غير المتوقعة، ولا عما يفعله طبيب أو متجر أو مستخدم آخر.

(ب) في أي مطالبة أخرى بموجب هذه الشروط، تقتصر مسؤوليتنا الكاملة تجاهك على المبلغ الأكبر من: ما دفعته لنا خلال الـ 12 شهرًا السابقة للمطالبة، أو 500 جنيه مصري.

(ج) لا شيء في هذه الشروط يحدّ أو يستبعد المسؤولية عن الغش أو الخطأ الجسيم، أو عن الضرر الناشئ عن عمل غير مشروع، أو أي حق يمنحه لك قانون حماية المستهلك رقم 181 لسنة 2018 أو أي قانون آمر آخر ولا يجوز التنازل عنه.

١١. الإنهاء

يمكنك التوقف في أي وقت وحذف حسابك من الإعدادات. ويجوز لنا إنهاء هذه الشروط بالنسبة لك إذا خالفتها مخالفة جسيمة أو متكررة، بعد إخبارك بالسبب متى أمكن.

١٢. القانون والنزاعات

يطبق القانون المصري. نرجو مراسلتنا أولًا؛ ونرد خلال 14 يومًا. وإذا لم نتفق، تختص محاكم الإسكندرية، مع احتفاظك بحقك في الشكوى إلى جهاز حماية المستهلك (الخط الساخن 19588) أو مركز حماية البيانات الشخصية.

١٣. التغييرات

إذا غيّرنا هذه الشروط، نحدّث هذه الصفحة وتاريخها وإصدارها، ونطلب موافقتك مرة أخرى في التطبيق قبل أن يسري التغيير عليك.
